Tipping Monkey Content Policy

Tipping Monkey strives to provide a community environment where members can freely share their ideas, comment and opinions in a responsible manner. It is not our goal to censor or moderate content that our members choose to share with others, however, since we are providing public platform for open communication, we also recognize the need to establish a set of ground rules in order to foster and maintain an positive environment that reflects the core values of Tipping Monkey.

General Content Guidelines

While Tipping Monkey is centered around finance and investing, we recognize that ideas and insights don't always fall within concrete boundaries, and therefore we welcome general freedom-of-speech among our members to keep discussions lively and interesting. Nonetheless, as a responsible web citizen and in maintaining compliance of legal requirements, Tipping Monkey does take a zero-tolerance approach to certain types of content, some of which are listed below:

Pornography

Users may not publish any written, image or video content that includes the representation of, but not limited to, the following will be removed: pornography and obscenity, pedophilia, incest, beastiality, and any types of commercial pornography offerings. In addition, Tipping Monkey, at its sole discretion, may moderate or remove any content that is deemed explicit, graphic or distasteful.

Tipping Monkey adopts a zero-tolerance policy towards Child Pornography and will report all incidents to the authorities.

Confidential Information

Users may not publish other people's confidential information, such as driver's license number, credit card numbers or Social Security Number, etc. Also, users may not publich information about someone else that is genrally considered private. This includes, but is not limited to: phone numbers and street addresses.

Hateful / Violent Content

Users may not publish content that promotes hate towards groups based on gender, age, religion, race or ethnic origin, veteran status and sexual orientation. The same goes for content that contains verbatim that is violent or threatening against a person or a group of people.

Spam, Viruses and Malware

Spamming or the transmission of viruses and malicious code is strictly prohibited. Hackers will be reported to the appropriate authorities.

Impersonation and Misrepresentation

Users may not impersonate to be someone else, or otherwise misrepresent themselves in such a way that may be construed as misleading or with the intention to confuse.

Illegal Activity

Anyone using Tipping Monkey to engage in fraudulent or unlawful enterprise will be reported to the authorities for investigation.

Copyright Material

Tipping Monkey is committed to investigating and responding to properly-formed notices of alleged copyright infringement. Please read the section below on Digital Millenium Copyright Act for further details.

Tipping Monkey's Observance of the Digital Millenium Copyright Act

Tipping Monkey treats all properly-formed notices of alleged copyright infringement seriously, and is committed to investigating and responding to them. Once verified, our typical response may include removing or disabling the content in question, and termination of the offending user's account.

In any case, Tipping Monkey reserves the right to document all alleged instances of copyright infringement for our records. In addtion, we may forward the your legal notice (with all personally-identifiable information removed) to third parties for publication and annotation.

Infringement Notification Procedure

You may find guidelines for properly formatted alleged copyright infringement notices at the US Copyright Office Web Site: http://www.copyright.gov. If you happen to be from another jurisdiction, it is advised that you adhere to the proposed format as listed below.

Your notice should include the items described below (preferably in the same order). For quickest response, send your legal notice in email to: copyright@tippingmonkey.com. We recommend that you enable delivery receipt to establish delivery of your notice. I you do not receive a response within 72 hours of delivery receipt, you may send a written version of your notice to our corporate mailing address.

  1. Precisely identify the original copyrighted work that you believe has been infringed upon. Online posts must be identified with the appropriate link (ideally, the permalink).
  2. Precisely identify the material that had allegedly infringed upon the original works identified above.
  3. Detailed contact information for us to contact you (email, phone, address).
  4. Include the following verebatim: "I believe, in good faith, that the use of the copyrighted material described above on the allegedly infringing web pages is not authorized by the copyright owner, its agent, or the law.".
  5. Include the following verbatim: "I swear, under penalty of perjury, that the information in the notification is accurate and that I am the copyright owner or am authorized to act on behalf of the owner of an exclusive right that is allegedly infringed."
  6. Electronically sign the document using your full legal name, in Capitals.
  7. Send the notice to copyright@tippingmonkey.com.
File Responsibly

Investigating allegations of copyright infringements consumes considerable resources and may incurr legal costs. We recommend that you consult your own legal counsel prior to filing a copyright infringement allegation notice if you are not certain whether material published on our site clearly infringes upon your copyright. The fair use doctorine covers significant grounds, and if, in the event that you were found to have materially misrepresented that published material had infringed upon your copyrights, you may be liable for damages, including but not limited to costs and attorneys' fees.

Counter Notifications

Due to our current modest scale of our operations, we will handle counter notifications pursuant to sections 512(g)(2) and (3) of the Digital Millennium Copyright Act on a best-effort basis.
